The incident happened at Belmont Nursery in Terrington St Clement, where he was working.
Rene Barclay, of the Crown Prosecution Service, said after considering the evidence the nursery operator, PS & JE Ward Ltd, based at King's Lynn, should be charged with corporate manslaughter.
It will also face a charge of failing to ensure the safety of an employee under the Health and Safety at Work Act 1974.
The company has been summonsed to appear at King's Lynn Magistrates' Court on November 23.
Police and the Health and Safety Executive were called to the nursery after reports that a man had suffered serious injuries. He died shortly after at the Queen Elizabeth Hospital in King's Lynn.
The company issued a statement through its solicitors which said it had recently been informed of the decision. It added: "Belmont Nursery has worked closely with police, the HSE and other agencies investigating the incident at the nursery.
"As formal legal proceedings are now under way it would be inappropriate for us to comment on any aspect of the case at this time.
"Everyone at Belmont Nursery remains profoundly saddened by the death of Mr Pieton, and his family have been, and are constantly, in our thoughts"
